All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Epsom College Online Services and Epsom College Content belong to Epsom College Ltd. Epsom College reserves all of its rights in Epsom College Content and Epsom College Online Services.
Nothing in the Terms grants you a right or licence to use any trade mark, design right or copyright owned or controlled by Epsom College.
Digital Rights Management
Epsom College may embed digital rights management security in Epsom College Online Services or Epsom College Content and/or use other content-protection measures. You may not adjust or circumvent or try to adjust or circumvent these technical measures.
1.2 Who makes Epsom College Website and online services available to me and what should I do if I have questions, comments, complaints or enquiries?
Epsom College Website and other online services are made available to you by Epsom College Ltd, Epsom College, College Road, Epsom, Surrey, KT17 4JH.
Any reference in the Terms to "you" or "your" means you as a user of any Epsom College Online Services. If you have or receive any enquiries which relate to the Epsom College, or any Epsom College Online Service and/or Epsom College Content, you should promptly refer to The Bursar at Epsom College on 01372 821133 or via email at firstname.lastname@example.org.

2. What are Epsom College Online Services?
2.1 In the Terms:
"Epsom College Online Services" are any Epsom College or other Epsom College authorised internet services and websites that enable you to access, view and/or listen to Epsom College Content on compatible devices and are identified as "Epsom College Online Services". Epsom College Online Services include the website at www.epsomcollege.org.uk, Epsom College Facebook page, Epsom College Twitter feed, Epsom College Flickr albums, Epsom College YouTube TV Channel and Epsom College eZine. Other services vary from time to time.
"Epsom College Content" means audio, video, text, images or other content made available by Epsom College to you through Epsom College Online Services and may sometimes include content which is owned or controlled by third parties which Epsom College is permitted to make available to you through the relevant Epsom College Online Service.
2.2 Availability of Epsom College Content
Epsom College Content is selected, edited, updated and made available to you by Epsom College through Epsom College Online Services at its sole discretion. The period of time during which you may access, view and/or listen to Epsom College Content using Epsom College Online Services may vary.

You acknowledge that Epsom College has absolute editorial control over all Epsom College Content at all times.

(g) You may not disrupt or try to disrupt Epsom College Online Services. You agree not to use Epsom College Online Services to distribute software viruses or other harmful programs, or use Epsom College Online Services to engage in harmful, harassing or otherwise objectionable activity, including activity inhibiting access to Epsom College Online Services by others.
(h) You may not harass or cause distress or inconvenience to any other person using Epsom College Online Services or transmit obscene or offensive content or disrupt the normal flow of dialogue within Epsom College Online Services, in particular, on social media platforms.
(i) You may not display Epsom College Content where it is on or in connection with Excluded Products or Services, namely products or services which:
- contain pornography and sexually explicit content;
- contain offensive text or images;
- incite hatred whether based on race, religion, gender, sexuality or otherwise, or promote, encourage or facilitate anti-social behaviour;
- contain gratuitous violence or promote, encourage or facilitate violence;
- promote, encourage or facilitate terrorism or other activities that risk national security;
- discriminate against any specific social group or otherwise exploit vulnerable sections of society;
- promote, facilitate or encourage illegal activity;
- are misleading, defamatory, or that contain illegal, or otherwise actionable content under UK law;
- infringe individual privacy;
- put the welfare of children at risk;
- promote the tobacco industry or the armaments industry (including gun clubs);
- where presence of an Epsom College application might be perceived as damaging Epsom College's reputation for accuracy and impartiality;
- and brings Epsom College into disrepute.
This list is not exhaustive and may be amended by Epsom College from time to time.
5. What are the features of Epsom College Online Services and how do they work?
5.1 Epsom College Online Services and your device
You can use Epsom College Online Services on a variety of compatible devices. The Terms apply to your use of Epsom College Online Services on any device. Epsom College Online Services or some of the features and functionalities may not be available on all devices. Epsom College makes no guarantee that all or any features of Epsom College Online Services will work on any particular device.
5.2 Connecting with other Epsom College Online Services users
Some of the Epsom College Online Services allow you to connect with your contacts or friends from social networking services who use Epsom College Online Services at the same time as you do, subject to any other terms or conditions which apply to your use of the relevant social networking services.
6. What obligations do I have under the Terms?

You must comply with the Terms, in particular the general restrictions on how you may use Epsom College Online Services.

8.1 Third parties
The Terms do not create or infer any rights that are enforceable by any person who is not party to the Terms.

You may not assign, sub-license or otherwise transfer any of your rights and obligations in the Terms to any other person.
8.3 What happens if there is a dispute arising out of the Terms?
Any disputes arising out of the Terms will be governed by and interpreted in accordance with the laws of England and Wales (or the laws of Scotland or Northern Ireland if you live there). If you choose to bring proceedings in connection with the Terms you must do so in the courts of England and Wales unless you live in Scotland or Northern Ireland, in which case you can choose to bring proceedings there.
